The Lee County Port Authority is facing a lawsuit from Private Sky Aviation over a plan to add an additional vendor for jet fuel to Southwest Florida International Airport.
Private Sky is currently the sole retail provider of retail Jet-A fuel to private and commercial planes.
The company is suing for an injunction to stop plans to add a second vendor, called a fixed-base operator; claiming there isn't enough airplane traffic in the area for the port authority to let other companies in.
There are two types of jet fuel sales: contract fuel for cargo jets, such as Fed Ex or UPS, and retail Jet-A sales.
In the lawsuit, they claim that cotract fuel services are an extremely low-profit business due to fuel storage costs and that bringing in a second vendor "will be a death sentence for Private Sky," stating the amount of fuel sales could not support two companies.
The attorney for Private Sky tells NBC2 that they did try to resolve the issue with the port authority before filing.
NBC2 also reached out to the Lee County Port Authority, and they said they do not comment on pending cases.
