A man suing Walt Disney Parks and Resorts over the death of his wife last October is running into some legal trouble.
In the original lawsuit, the family of Kanokporn Tangsuan says the woman, who had a severe allergy to nuts and dairy, died after eating at Raglan Road Irish Pub at Disney Springs.
According to the lawsuit, the family made sure the waiter was aware of the allergy and went on to say the waiter confirmed the food was safe multiple times.
After dinner, the lawsuit says Tangsuan separated from her family to go shopping, which is when she collapsed on the floor. The woman was rushed to the hospital, but was pronounced deceased.
Now, Disney wants to dismiss the $50,000 lawsuit because the plaintiff, Jeffery Piccolo, signed up for Disney+.
Court documents show that Piccolo signed up for a one-month trial of the streaming service back in 2019. According to the documents, Disney's lawyers argue that the terms and conditions of the site say any dispute of any kind must be settled out of court.
Company lawyers also claim because Piccolo used Walt Disney Park's website to buy tickets to Epcot, Disney is shielded from the lawsuit.
The man is suing from the estate of his wife.
