A Fort Myers man is facing the maximum penalty after being found guilty of possession with intent to distribute a controlled substance on Wednesday.
Nicholas Smith, 45, was sentenced to 20 years in federal prison after a bench trial.
According to evidence presented at trial, on September 5, 2023, officers with the Fort Myers Police Department stopped Smith for multiple traffic infractions near Winkler Avenue and Fowler Street in Fort Myers.
During a search of Smith, officers say they found a large plastic bag containing 11 smaller bags of a pink powdery substance that later tested positive for Para-fluorofentanyl and fentanyl.
Homeland Security led the investigation of the case with the help of the Fort Myers Police Department.
Smith's sentencing is scheduled for November 18.
