A man accused of killing his brother in Cape Coral before fleeing to Pennsylvania was transferred to the Lee County Jail and booked on Monday.
John Tolbert, 58, is back in Lee County on homicide charges, according to documents.
In April, Cape Coral police responded to a home in northwest Cape Coral for reports of a person in cardiac arrest.
According to CCPD, officers and Lee County EMS arrived at the residence to find Francis G. Tolbert, 71, bleeding from the back of his head. He was declared dead at the scene.
During the investigation, police found a gun shell casing near Francis's body, leading officers to believe his injuries were suspicious and foul play may have occurred.
CCPD detectives began investigating and learned that a brother of the victim, identified as John William Tolbert, 58, had been in the home with Francis before fleeing the scene approximately an hour before police arrived.
Medical examiner's office performed an autopsy and the preliminary reports revealed Francis had a bullet fragment in his head.
Pennsylvania State Troopers pulled over Tolbert on April 30 for a traffic infraction at the New Stanton Travel Plaza in Westmoreland County, according to Pennsylvania State Police.
He was arrested on the original warrant from Cape Coral for manslaughter with a weapon.
CCPD said he would be extradited back to Cape Coral because the charges are out of Lee County.
Tolbert is set to make his first appearance in Lee County.
