The trial for an Uber driver accused of raping a woman began with jury selection on Tuesday.
Felix Torres, 39, has been in jail since December of 2022. On Tuesday, he will face a Lee County judge.
Torres will enter trial with no outstanding offer. NBC2 was in the courtroom on Dec. 9 when the state said it is dropping the kidnapping charges on Torres, but he still faces a charge of sexual battery with force while wearing a mask.
Lee County Deputies said Torres dropped off his passenger at Ashlar Apartments, then raped her. Cameras around the apartment community caught the moments before the attack.
It is what helped detectives track Torres down. In the video, you can see a man pulling a mask over his head while he follows her. LCSO said Torres then took her phone and ran off.
What's the reason for the delay in the case? Torres' phone was confiscated by detectives, but he reportedly refused to give them the passcode.
The judge then ruled Torres won’t go to trial, and he will remain in jail until he gives up the passcode to his phone.
Trial was originally supposed to begin in January of this year.
Trial began on Tuesday with jury selection. Torres' attorney requested all potential jurors be brought forward for selection.
