A Cape Coral man accused of killing his older brother before fleeing to Pennsylvania is expected to appear in court on Tuesday.
John Tolbert, 59, was charged with second-degree murder for the killing of his older brother, Francis G. Tolbert, 71, at his home in Northwest Cape Coral.
Cape Coral police said they were called to the home last April after receiving reports of a person going into cardiac arrest.
Investigators say they found Francis dead, bleeding from the back of his head, with a spent shell casing near his body.
Officers say John was at the home just an hour before. He wasn't arrested until September in Pennsylvania and was later extradited to Cape Coral .
Tolbert is expected in court at 8:30 a.m. Tuesday.
