Fort Myers driver blows double the legal limit after swerving on San Carlos Blvd., deputies say

FORT MYERS, Fla. —

A motorist was arrested for driving under the influence early Monday morning after deputies say he was swerving into oncoming traffic and later provided breath samples more than double the legal limit.

The Lee County Sheriff’s Office reports the incident occurred around 12:30 a.m. near the intersection of San Carlos Boulevard and Pine Ridge Road in unincorporated Fort Myers.

According to the arrest report, a deputy observed a blue Volvo S60 make an abrupt stop on the roadway with no traffic ahead of it. As the vehicle continued onto Pine Ridge Road, it reportedly swerved into the opposite lane while braking and accelerating erratically.

Upon initiating a traffic stop, the deputy made contact with the driver, identified as 47-year-old Herry Juniar Arfian. The report notes that Arfian exhibited bloodshot, watery eyes and slurred speech, and an "overwhelming odor" of alcohol was coming from the vehicle.

While Arfian was searching for his license, the deputy noticed a firearm in the center console. For officer safety, Arfian was asked to exit the vehicle. Deputies say he was unsteady on his feet and staggering.

Arfian informed deputies he was diabetic. Lee County Emergency Medical Services responded to the scene and measured his blood sugar at 248. However, paramedics determined he was not having a medical episode that would cause the erratic driving patterns observed, clearing him for field sobriety exercises.

During the exercises, the report states Arfian struggled with balance, missed heel-to-toe steps, and used his arms for stability. At one point during the "walk-and-turn" portion, the deputy noted that Arfian "nearly fell," and the exercise was stopped for safety reasons.

Deputies arrested Arfian for DUI. Because a dog was found inside the vehicle, Lee County Animal Control was dispatched to take possession of the animal.

At the jail, Arfian consented to a breath test. He provided two samples registering 0.166 and 0.174 blood alcohol content (BAC). In Florida, the legal limit is 0.08, and penalties are enhanced for a BAC of 0.15 or higher.

Arfian was booked into the Lee County Jail, charged with driving under the influence (.15 or higher).
