Man accused of making bomb threat to Hendry County Courthouse arrested

HENDRY COUNTY, Fla. —

A North Fort Myers man was arrested after he was accused of making a bomb threat to the Hendry County Courthouse that forced an evacuation Thursday.

According to the Hendry County Sheriff's Office, Don Michael Anthony Foligno, 41, was arrested after he was accused of making the threat to postpone a court appearance.

The bomb threat was made to the courthouse around 9:40 a.m., and the courthouse was evacuated.

The Hendry County Court Bailiffs and Security as well as road patrol units responded and searched the courthouse and courtrooms. The Lee County Sheriff's Office Bomb Squad had bomb-sniffing dogs for a secondary search of the courthouse. No suspicious packages or devices were found, the sheriff's office said.

By Friday night, witnesses were interviewed at a home Foligno was at, and he was then arrested. Detectives reported that they were told he had a court date at 9 a.m. that day and he was reportedly concerned about the bond amount.

Deputies said the call made to the Hendry County Courthouse was citing "there were two bombs planted there and were to go off in one hour, this is no joke." The sheriff's office said that according to reports, the threats were made to postpone the appearance.

Foligno was taken into custody and transported to the Lee County Jail. On Tuesday, Foligno was transported to the Hendry County Jail where he is facing charges of false report of bomb/explosive/weapon of mass destruction and use of two-way communication device to facilitate a felony, HCSO said.
