Lee County man arrested after baby suffers skull fracture

LEE COUNTY, Fla. —

A man was arrested and accused of child abuse after a 5-week-old boy went to the hospital with a skull fracture in June 2025 in Lee County.

According to the Lee County Sheriff's Office's warrant, Miguel Toma Gomez, 38, faces charges of aggravated child abuse and battery.

On June 12, 2025, the sheriff's office said they received a call after the baby arrived at Golisano Children's Hospital with the fracture and Gomez was identified as the suspect.

Around 2 p.m. that day, a woman told deputies she realized that the boy lost consciousness while he was sleeping, and Lee County EMS was called.

The report states the woman appeared to have injuries, but she did not let deputies take pictures of her injuries.

Detectives said they collected the clothes and blanket the baby had during the incident, and also took pictures of the baby, who was not suffering from visible bumps or bruises.

The Florida Department of Children and Families also responded and began investigating.
