A man is accused of wielding a gun under the influence of alcohol and breaking into a front porch in Ave Maria, according to the Collier County Sheriff's Office.
An arrest report says that deputies were called to an apartment on Double Eagle Circle in reference to a suspicious person. It adds that deputies heard a "banging" sound and someone speaking out loud.
Deputies say they approached the suspect, David Xavier Silva, 22, who was standing inside of the lanai of the residence holding an "AK-47" style pistol and wearing a mask and gloves. Deputies add that they told Silva to drop the gun, but he refused.
CCSO says that when they told Silva to drop the gun again, he complied. Silva was detained. The caller reportedly told deputies that they had called from someone else's phone because Silva was attempting to break into his ex-girlfriend's home. The caller added that the front enclosure door of the lanai was locked before Silva came in.
Silva's ex-girlfriend reportedly told deputies that he showed up unannounced and was not invited. The report says that she told the caller to call 911 because she could see Silva in the lanai via a Ring camera and could see him banging on the door.
After being detained, the report says that Silva told deputies he had been drinking hard lemonade, an alcoholic beverage, before going to his ex-girlfriend's house. He added that he carries the pistol around to protect himself from bears in the area.
The report says that Silva told deputies he had no intention to harm his ex-girlfriend, however, he could not explain why he drew the gun from his waistband. He added that he just wanted to speak with her because they had just broken up.
Silva was taken to the Immokalee Jail Center and is facing charges of armed burglary of a structure or conveyance, wearing a hood or mask on the property of another and using a firearm under the influence of alcohol.
