Wednesday's court hearing was brief, but attorneys for the man accused of killing a gas station clerk in April in Fort Myers outlined where the case stands now and the legal steps that come next. Only Gulf Coast News was in court for Rolbert Joachin's hearing Wednesday afternoon. Prosecutors said they are now seeking the death penalty under two different laws. One is that they say this was a premeditated murder, the other is because Joachin is currently in the country illegally from Haiti. Surveillance at the Chevron gas station on Dr. Martin Luther King Jr. Boulevard showed gas station clerk, Nilufa Easmin, walk out and a man is accused of killing her with a hammer in April.Police say he reportedly broke the victim's SUV window to get her attention.During Wednesday's hearing, defense attorneys briefly noted there may be conflicts of interest involved in this case, but offered few details. They also plan to file constitutional challenge motions as the case moves on. Joachin's next hearing is scheduled for Sept. 9.
