A Lee County Sheriff’s Office deputy was fired Wednesday after an internal affairs investigation found he violated agency policy during and after a North Fort Myers pursuit of a reported reckless driver in April.
According to disciplinary records, Deputy First Class Gabriel Hollow was recommended for “appointment withdrawn."
Deputy Johnathan Reid also received a four-day suspension without pay and six months of disciplinary probation, the report noted.
The case stems from an incident on April 25 involving a maroon Hyundai that deputies said was being driven recklessly and at high speed. According to the report, Hollow attempted a traffic stop, before Hollow, Reid and another deputy pursued the vehicle when the driver fled.
Investigators said units were ordered over the radio to discontinue the pursuit, but Hollow and Reid reportedly continued following the vehicle and later found it in the Indian Creek community.
Internal affairs found Hollow committed insubordination, made inaccurate statements in official reporting and handled his patrol vehicle carelessly. A separate allegation of conduct unbecoming was not sustained.
According to the report, video contradicted Hollow’s account that he had stopped in the roadway and the suspect vehicle forced him into a ditch. Investigators also said Hollow admitted in an interview that some of his earlier statements were inaccurate.
The report says Hollow was driving 68 mph in a 35 mph zone on Coon Road and going through the Donald Road intersection at 58 mph without stopping at a stop sign. Hollow acknowledged his driving created a safety concern, according to the records.
Reid was found to have violated policy on insubordination and failing to monitor his radio. In his statement, Reid said he did not intentionally ignore the order to disengage but may have missed radio traffic because of distraction, radio settings or “tunnel vision,” according to the report.
A July 2 notice of discipline signed by Sheriff Carmine Marceno said Reid’s suspension and probation would take effect later in July.
The notice of discipline was signed by Marceno for Hollow on Wednesday.
The records identify the driver of the Hyundai as Angel Gutierrez. He was arrested in connection with the incident.
