A Lee County judge decided on Thursday that a man accused of the armed burglary of a Cape Coral home will be held without bond.
Christopher Santos, 35, was arrested late Tuesday night after Cape Coral police said they found him inside a closed pool bathroom inside a screened lanai at a Cape Coral property.
According to the Cape Coral Police Department, officers received reports of a man walking around a Cape Coral home during the day and returning later in the evening. When officers found him in the bathroom later that night, they said they discovered multiple firearms inside the bathroom, including a loaded AR rifle, two handguns with optics and lights, camo clothing and blue tennis shoes.
"We are not sure what his true intentions are, but it could have ended in an abduction or possible murder," Mercedes Simonds with CCPD said.
Santos appeared before a Lee County judge Thursday morning. According to court notes, the state argued that Santos should be held without bond due to his proximity to the victim and the weight of the evidence.
Santos' defense argued that the state had not provided any actual evidence. The defense continued by saying Santos was actively searching for employment, had never failed to show up to court, had one DUI 11 years ago, is a U.S. citizen, and never made any actual threats to the witness. The defense also added that the victim is not currently living at the home, as it is up for sale.
Santos told the judge that he currently did not have money for bond, but that he has other weapons and would willingly turn them in, stay away from the home, and wear a GPS if given bond.
The judge ultimately ruled that Santos would be held without bond. The judge added that there is substantial evidence that shows Santos is a danger to the public, and that he will stay in jail until his trial.
