FORT MYERS, Fla. (WINK) — The trial for Cape Coral Councilwoman Rachel Kaduk, accused of DUI, was postponed after new information surfaced in court on Monday.
Kaduk was arrested in December and is accused of driving drunk and refusing to submit to a DUI test. Police body-camera footage captured the arrest.
The delay centers on a key witness: the person who called 911. Defense attorneys said they recently discovered that the civilian gave about six media interviews after the incident.
"In this interview, she basically said that she came all the way from Cape Coral Parkway, which is nowhere near that, and this completely changes her testimony," the defense attorney said. "[Because] now, I have no idea what she is talking about."
Defense attorneys argued that some statements in the interviews may differ from the original 911 call and could help their case. Prosecutors said they were unaware of the interviews and agreed to review them.
A judge ordered all interview videos of the 911 caller to be turned over to both sides before the witness is deposed. The judge granted more time for both sides to obtain and review the videos.
