Deputy's attorney, attack victim react after deputy cleared in fatal 2025 Charlotte County shooting

The state attorney’s office has concluded that Charlotte County Deputy Timothy Poole will not face any criminal charges in the fatal shooting of Daniel Burch in September of 2025, at a condo complex on Saxony Circle, following a months-long investigation into the incident. The confrontation began after Terry Beggs called deputies, reporting that Burch had attacked him. Beggs said the incident has had a lasting impact on his life. Body camera footage from the scene shows Burch grabbing at his pockets and reaching for Poole’s hand before the deputy ordered him to get on his knees. Those were the last words Burch heard before Poole fired, killing him. Beggs believes the situation could have been handled differently. “He should have called for backup...he should have kept his distance where the guy couldn't slap the gun out of his hand,” Beggs said. Poole retired while on leave after the shooting, but Charlotte County Sheriff Bill Prummell has since stated that Poole would have been fired for violating department policy and training. Steven Leskovich, Poole’s attorney, said “in the very beginning, we were confident that they were going to come back with no criminal wrongdoing." Leskovich also criticized the sheriff’s comments. “For the sheriff to come out and say it's disheartening that they didn't prosecute him, that's astounding to me." Despite his belief that the situation could have been handled differently, Beggs ultimately supports the state attorney’s decision. “I mean, this guy killed a guy, and this guy saved me from great bodily danger or death,” Beggs said.
