Naples Mayor Teresa Heitmann asks judge to end probation early in DUI case

NAPLES, Fla. (WINK) — Naples Mayor Teresa Heitmann is asking a Collier County judge to end her probation early, saying she has completed all court-ordered conditions and paid all financial obligations in her DUI case.

Heitmann's attorneys filed the motion for early termination of probation Sept. 11 in Collier County Court. A notice filed four days later says the motion will be heard at 10 a.m.

According to the motion, Heitmann was sentenced to 12 months of supervised probation after pleading no contest in February to driving under the influence with a blood-alcohol level of 0.15 or higher. Her sentence allowed her to seek early termination after six months if she completed her court-ordered conditions.

Her attorneys say Heitmann has now completed all conditions of probation and that no terms or conditions remain outstanding. The motion also says all financial obligations and assessments have been paid and that no restitution was ordered.

The motion acknowledges Heitmann's previous probation violation. It says an affidavit alleging a violation involving the unlawful use or possession of cannabinoids was filed in April.

In July, Judge Rob Crown found Heitmann in violation of probation and modified her sentence to include 10 days in the weekend work program. Her probation was also extended through May 16, 2027.

Heitmann had disputed the drug-test result that led to the violation, telling the court she had not used marijuana. Her attorneys presented other tests they said were negative, but the judge ultimately found the probation violation.

Heitmann's latest filing asks Judge Crown to enter an order terminating her probation. The State Attorney's Office was electronically served with the motion, according to the filing.

The court has not yet ruled on the request. A hearing is set for September 29 at 9:00 am.
